This notice describes how the website is managed with regard to the processing of personal data of users who visit it, as well as data processing practices through this site. In compliance with Articles 13 (for data collected from the data subject) and 14 (for data not collected from the data subject) of Regulation (EU) 2016/679 (hereinafter GDPR), the following information is provided to Users of this Website, which refers exclusively to processing carried out through this Website and not through other websites that may be visited via links from this one, for which we suggest reviewing the respective notices provided by the respective Data Controllers. This Website and any services offered through the Website are reserved for persons who have reached the age of eighteen. The Data Controller therefore does not process personal data relating to persons under the age of 18. At the request of such Users, the Data Controller will promptly delete all personal data inadvertently collected.

Data Controller Crescini Pietro Srl, with registered office at Via A. Volta, 36 – 46043 Castiglione Delle Stiviere (MN), Tax Code and VAT No. 01368920201 (hereinafter "Controller"). The Controller reserves the right to appoint as Data Processor for personal data managed for the purposes of technical assistance, maintenance, technical management and similar of this Website a web agency or consultant, whose details may be communicated upon request to the addresses indicated above. The Controller and the Processor also process Users' data through their internal Appointees, specifically designated with instructions and authorized for processing.

2. Categories of Data Processed and Sources of Origin

· Browsing data (the computer systems and software procedures used to operate this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes: IP addresses, browser type used, operating system, domain name and website addresses from which access or exit was made, information about pages visited by users within the site, access time, time spent on individual pages, internal path analysis and other parameters relating to the user's operating system and computer environment. Such technical/IT data is collected and used exclusively in an aggregated and anonymous manner. Such data is processed for the purpose of enabling and monitoring correct use of this website as well as obtaining anonymous statistical information on its use, and is deleted immediately after processing)

o Common data (identification, personal, billing and similar data)

o Only exceptionally special category data (Art. 9 GDPR)

We may primarily process browsing data, as well as cookies.

We may also process data voluntarily provided by the user, for example through the contact form or by sending an email, including common personal data (identification, personal, billing and similar) and exceptionally special category data pursuant to Art. 9 GDPR or criminal data pursuant to Art. 10 GDPR to the strict extent made necessary by the information request received and with the prior consent of the data subject.

Data may come from automatic sources or voluntary sources, as well as from public sources. For example, they may come from user browsing, which may carry information relating to previous visits to other sites, including in particular cookies and other similar technologies. Data may also be voluntarily provided by the user or by related parties. Other data may come from public sources, such as those processed in the context of research and from searches, public databases and similar.

3. Purpose of Processing

The personal data of Website Users, as described above, will be processed in the manner and forms prescribed by the GDPR, for the performance of the Website's own functions, with particular, but not exclusive, reference to page browsing and the data collection procedures described therein, contact forms, any registration/access to reserved area procedures, newsletter subscription and similar. In particular, the personal data provided to the Controller will be processed for the following purposes:

· to follow up on specific requests made to the Controller by the User through the Website and its communication tools (contact forms, information request forms and similar);

· for informational communications relating to the Controller's own services, following a request for information via email or completion of the contact form and other communication tools;

· for any registration for events organized by the Controller and related activities (for example, verification of participation, notices regarding any updates or changes to the event, etc.);

· for other ancillary or related purposes to those indicated above and in any case falling within the scope of the Website's activities;

The processing of data provided in general will be carried out, including following automatic collection during browsing, solely for the purpose of verifying and controlling access to the Website. This also applies to technical cookies, meaning session cookies, functionality cookies or analytics cookies that meet the requirements specified by the Italian Data Protection Authority. In particular, regarding the latter, it is clarified that they can be assimilated to technical cookies where they are created and used directly by the Website. In any case, for said analytics cookies, the Website, also in compliance with the Authority's clarifications, has provided for the anonymization of IP addresses and the amendment to data processing; the collection and use of the aforementioned browsing data (without prejudice to the anonymization of IP addresses) allow monitoring of the Website's performance and enable improvement of the service offered, proposing a better browsing experience to the User. Please refer to the specific Cookie Notice for further information.

4. Legal Basis of Processing

The processing of personal data is based on the fulfillment of contractual or pre-contractual obligations relating to the request made by the User (for example, requests for information about the services provided by the Controller, quote requests, etc.), as well as, where necessary, on consent through the free and informed completion of the appropriate information fields in the form dedicated to data collection and provision and the ticking of the appropriate checkbox where provided.

It is specified that the completion of specific fields provided in forms for requesting information is inherent to the request itself and that therefore this entails the fulfillment of a pre-contractual or contractual obligation, depending on the context. Consent may be requested subsequently for the processing of additional data.

A specific privacy notice will be present wherever necessary (notice different from this one).

The processing is in any case also based on legitimate interest, including the right to information, for which reference is made to the following paragraph.

5. Legitimate Interest of the Controller

The processing of personal data is also based on the legitimate interest of the Controller, such as the exercise of its rights in the context of the information society, the performance of the contractual service and the carrying out of direct marketing operations (in the manner, by the means and within the timeframes provided by the regulations).

6. Mandatory Nature of Data Provision

The provision of browsing data by Users, for the purposes described above, depends on the degree of privacy that the User has enabled or disabled through their browser. In some cases, disabling may impair browsing on this Website. For certain modules of this Website, the provision of browsing data and/or the use of technical cookies is mandatory for the correct functioning of the Website itself.

The provision of certain personal data is in any case necessary for the very structure of the Website and its procedures. Any request for other optional data will instead be preceded by an appropriate approval checkbox. The provision of all other data is optional, in accordance with the type of information that the User wishes to provide to the Website.

Without prejudice to the above, for example, the provision of the email account is necessary to be able to respond to the request made through the contact form, as well as other mandatory data indicated therein with an asterisk. Other data is optional.

Failure to provide the data necessary for the requested action (for example, the email account through the form for requesting information by this means) makes it impossible for the Controller to fulfill the request.

PROVISIONS APPLICABLE TO ALL PROCESSING

In any case, even where the data subject has given consent to authorize the Controller to pursue all the purposes mentioned in the points above, they will remain free at any time to revoke it.

You are specifically and separately informed, as required by Art. 21 of the Regulation, that the data subject has the right to object at any time to the processing of personal data concerning them carried out for the purposes described above and that, if the data subject objects to processing, the personal data may no longer be processed for such purposes.

7. Possible Recipients of Personal Data

Data may be communicated to companies connected, affiliated or controlled by the Controller, as well as to consultants, or also to third parties who operate, including on behalf of the Controller, for the fulfillment of services connected to the purposes indicated in this notice, both within the EU and outside the EU (in the latter case, these will exclusively be parties adhering to current regulations).

Browsing data and similar (for which reference is made to the above), as well as profiling cookies including those of third parties (for which reference is made to the Cookie Notice of this Website), which will be communicated to the respective interested third parties, where they do not manage them directly as Data Controllers.

In any case, data may be communicated to Data Processors, as well as to persons authorized for processing and duly instructed, always within the scope of the processing purposes.

8. Retention Period

Data voluntarily provided by the Data Subject will be retained until express revocation by the Data Subject, including through action on their browser, cookie clearing, express request or otherwise manifested. Browsing data will be retained, in compliance with the principle of proportionality, in a form that allows identification of the Data Subject for a period of time not exceeding that necessary for the purposes for which they were collected or subsequently processed.

Cases where it is necessary to retain data for an additional period of time to defend or assert a right or to comply with any legal obligations or orders of the Authorities are excluded from the above terms.

9. Rights of the Data Subject

Each Data Subject has the right of access, rectification, erasure (right to be forgotten), restriction, receipt of notification in case of rectification, erasure or restriction, portability, objection and not to be subject to an automated individual decision, including profiling, pursuant to Articles 15 to 22 of the GDPR. These rights may be exercised in the forms and within the terms of Art. 12 GDPR, by written communication sent to the Controller (see point 10).

The Controller will provide an adequate response as soon as possible and in any case within 1 month of receiving the request.

10. Right to Withdraw Consent (How to Exercise Your Rights)

It is possible to withdraw consent, where provided, at any time and/or exercise your rights by sending:

- a registered letter with return receipt to the undersigned with an express request (see the address on the letterhead); - an email to info@crescinipietro.it

11. Complaints

Each Data Subject has the right to lodge a complaint pursuant to Articles 77 et seq. of the GDPR with a supervisory authority, which for Italy is the Italian Data Protection Authority (Garante per la protezione dei dati personali). The forms, methods and terms for filing complaints are provided and governed by current national legislation. The complaint is without prejudice to administrative and judicial actions, which for Italy may be brought alternatively before the same Authority or the competent Court.

12. Profiling

Personal data provided through browsing on this website and any completion of forms published therein may be subject to profiling by third-party providers through third-party cookies.

Profiling allows such third-party providers, independent Data Controllers of their respective personal data processing for profiling purposes, different from the Controller of this website, to evaluate certain personal aspects of the Data Subject relating in particular to their preferences, interests, tastes with reference to pages consulted and activities carried out, in order to allow such independent and different Controllers to offer the Data Subject a more specific service tailored to their needs.

14. Social Media Plug-ins

This site may contain plug-ins from some social media (e.g. Facebook).
